Overview
Tovar Law & Associates PLLC is seeking a bilingual Immigration Attorney specializing in Removal Defense and EOIR proceedings to join our legal team in Weston, Florida.
This role is focused on representing individuals and families in immigration court and developing effective strategies for clients facing removal from the United States. The attorney will handle cases before the Executive Office for Immigration Review (EOIR), including Master Calendar Hearings, Individual Merits Hearings, bond proceedings, motions, and appeals.
The position requires travel as needed for immigration court appearances, hearings, detained-client matters, and other case-related proceedings.
We are looking for an attorney with strong courtroom advocacy, legal writing, and case-strategy skills who is comfortable managing complex immigration litigation and communicating directly with clients throughout the process.
Minimum Requirements
- Active license to practice law in any U.S. state or territory
- Law degree and legal education sufficient to qualify for admission to practice in a U.S. jurisdiction, including foreign-trained attorneys who have completed an LL.M. where applicable
- Full professional fluency in Spanish and English, both oral and written
- Experience handling immigration matters involving removal defense or immigration court proceedings
- Strong legal research, writing, and oral advocacy skills
- Ability and willingness to travel for court appearances and other case-related matters
Preferred Qualifications
- 3+ years of immigration law experience, particularly in removal proceedings and EOIR litigation
- Experience appearing at Master Calendar Hearings and Individual Merits Hearings
- Experience with asylum, withholding of removal, Convention Against Torture (CAT), cancellation of removal, adjustment of status in removal proceedings, and waivers
- Experience with bond hearings and detained immigration matters
- Experience drafting and litigating motions to reopen, motions to reconsider, motions to terminate, motions to continue, motions to change venue, and other EOIR motions
- Familiarity with Board of Immigration Appeals (BIA) appeals
- Federal immigration litigation experience is a plus
Duties and Responsibilities
- Represent clients in removal proceedings before Immigration Courts and EOIR
- Appear at Master Calendar Hearings, Individual Merits Hearings, bond hearings, and other immigration court proceedings
- Travel as required for hearings, court appearances, detention facilities, client matters, and other case-related proceedings
- Conduct client consultations and evaluate potential defenses to removal and available forms of relief
- Develop individualized litigation strategies based on the facts, procedural posture, and applicable immigration law
- Prepare applications for asylum, withholding of removal, CAT protection, cancellation of removal, adjustment of status, waivers, and other forms of relief
- Gather, review, and organize documentary and testimonial evidence for immigration court proceedings
- Prepare clients and witnesses for testimony and court appearances
- Conduct direct and cross-examinations and present oral arguments before Immigration Judges
- Draft persuasive motions, legal briefs, memoranda, declarations, and other court filings
- Conduct legal research regarding immigration statutes, regulations, BIA precedent decisions, and federal court case law
- Prepare BIA appeals and appellate briefs, when applicable
- Communicate regularly with clients regarding case strategy, deadlines, court appearances, and case developments
- Maintain accurate case records and ensure compliance with all EOIR filing requirements and deadlines
- Supervise and coordinate with paralegals and legal assistants working on removal defense matters
- Collaborate with the firm's legal team on complex litigation strategy and case preparation
- Stay current on developments in immigration law, EOIR procedures, and relevant case law

- Excellent professional communication skills in both Spanish and English
