About the Role:
We are seeking a highly skilled and detail-oriented Immigration Attorney to join our team. This position is ideal for an attorney with strong legal research and writing skills who is passionate about immigration law and appellate advocacy. The attorney will focus on drafting trial briefs before the Immigration Courts, appellate briefs before the Board of Immigration Appeals (BIA) and U.S. Courts of Appeals, as well as federal litigation, including mandamus actions and habeas corpus petitions before the U.S. District Court.
Key Responsibilities:
- Conduct in-depth legal research on complex immigration issues, including statutory and case law analysis.
- Draft persuasive trial briefs, motions, and legal memoranda for submission before immigration courts.
- Prepare appellate briefs and responses for cases before the Board of Immigration Appeals (BIA) and U.S. Courts of Appeals.
- Draft and file mandamus actions and habeas corpus petitions in the U.S. District Court to challenge unlawful detention and delays.
- Assist in the preparation of petitions for review and legal arguments before federal courts.
- Stay updated on changes in immigration laws, regulations, and policies to ensure effective advocacy.
- Collaborate with other attorneys and legal staff to develop legal strategies for complex immigration cases.
- Maintain detailed case files and ensure timely filing of legal documents.
Qualifications:
- Juris Doctor (J.D.) from an accredited law school.
- Licensed to practice law in Virginia.
- Minimum 3 years of experience with a focus on legal research, brief writing, and appellate litigation.
- Strong knowledge of immigration statutes, regulations, and case law, particularly in removal defense and federal litigation.
- Excellent legal writing and analytical skills, with the ability to draft clear, persuasive, and well-researched legal documents.
- Prior experience with BIA appeals, petitions for review, and federal district court litigation is highly desirable.
- Ability to work independently and manage multiple deadlines in a fast-paced legal environment.
- Commitment to immigrant rights and a passion for advocacy.
Preferred Skills:
- Experience with habeas corpus and mandamus litigation in federal courts.
- Knowledge of administrative law and constitutional issues related to immigration.
- Bilingual proficiency (Spanish or another language commonly spoken by immigrant communities is a plus).
