Position Summary
The Federal Compliance & Immigration Specialist is responsible for ensuring the organization’s full compliance with federal contractor obligations (OFCCP, EEO, E-Verify) and managing all aspects of workforce immigration and global mobility. This role serves as the primary liaison between HR, legal counsel, the Facility Security Officer (FSO), and federal agency contracting officers. The ideal candidate combines deep expertise in U.S. immigration law with hands-on knowledge of affirmative action planning, federal record-keeping, and security clearance processes within an IT staffing or professional services environment.
Key Responsibilities
Federal Contractor Compliance (OFCCP & EEO)
- Develop, manage, and maintain the company’s Affirmative Action Plans (AAPs), ensuring full compliance with Executive Order 11246, Section 503 of the Rehabilitation Act, and the Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA).
- Prepare and submit annual EEO-1 Component 1 and VETS-4212 reports within prescribed federal deadlines.
- Conduct periodic internal audits of hiring, promotion, compensation, and record-keeping practices to ensure ongoing readiness for Office of Federal Contract Compliance Programs (OFCCP) desk audits and on-site evaluations.
- Administer and enforce rigorous E-Verify and Form I-9 compliance protocols for all new hires, with particular attention to employees assigned to federal worksites.
- Monitor regulatory developments—including executive orders and OFCCP directive updates—and advise leadership on necessary policy changes.
Immigration & Global Mobility
- Oversee the full lifecycle of employer-sponsored immigration cases (H-1B, L-1, TN, E-3, O-1, PERM, I-140, Adjustment of Status) in coordination with outside immigration counsel.
- Serve as the primary point of contact for foreign national employees, providing guidance on visa status, travel compliance, and work-authorization timelines.
- Maintain a centralized immigration case-tracking system with automated alerts for filing deadlines, RFE responses, and status expirations.
- Partner with Talent Acquisition and hiring managers to evaluate visa sponsorship feasibility for prospective candidates and ensure compliant onboarding.
Contract & Security Liaison
- Collaborate with the Facility Security Officer (FSO) and federal contract managers to verify that all employees—including foreign nationals—satisfy agency-specific background check, badging, and security clearance requirements.
- Track and report on workforce demographics, visa statuses, and clearance eligibility to prevent disruptions to active federal task orders.
- Maintain auditable records of all compliance and immigration activities in accordance with federal retention schedules.
Required Qualifications
- Bachelor’s degree in Human Resources, Business Administration, Legal Studies, or a related field.
- 3–5+ years of progressive experience in HR compliance, immigration case management, or global mobility—preferably within IT staffing, professional services, or federal government contracting.
- Deep working knowledge of U.S. immigration processes and agencies (USCIS, DOL, DHS) and familiarity with temporary and permanent work-visa categories (H-1B, L-1, PERM, etc.).
- Demonstrated expertise with OFCCP regulations, Affirmative Action Plan development, and federal EEO record-keeping requirements.
- Exceptional organizational skills with the ability to manage multiple concurrent cases and deadlines with high accuracy.
- Strong communication skills with the proven ability to translate complex legal and federal regulatory jargon into clear, actionable guidance for employees and executive leadership.
Preferred Qualifications
- SHRM-CP/SCP, PHR/SPHR, or Certified Immigration Specialist (CIS) certification.
- Experience with HRIS platforms (e.g., Workday, UKG, ADP) and immigration case-management software (e.g., INSZoom, Envoy Global, LawLogix).
- Prior experience responding to OFCCP compliance evaluations or DOL audits.
- Familiarity with federal security clearance processes and NIST 800-171 contractor requirements.
