Roles & Responsibilities:- Provide comprehensive legal support on IT employment and labor laws, ensuring compliance with federal, state, and local regulations.
- Manage and process U.S. work visas, including H-1B, OPT, CPT, Green Card, EAD, and other employment-based visa categories.
- Collaborate with immigration attorneys to prepare and file visa petitions, extensions, and amendments for employees placed with IT clients.
- Maintain accurate records of visa statuses, expiration dates, and compliance requirements, ensuring timely renewals and updates.
- Act as a liaison between employees, clients, and legal counsel to address visa-related inquiries and resolve issues.
- Provide legal guidance to employees placed with IT clients, addressing their concerns and ensuring smooth onboarding and employment experiences.
- Draft, review, and maintain employment contracts, offer letters, non-compete agreements, and other legal documents related to employee placement in IT staffing.
- Ensure compliance with employment eligibility verification (I-9) and E-Verify requirements.
- Stay current with changes in U.S. immigration laws, labor laws, and IT industry regulations to offer accurate and timely guidance.
- Assist with resolving employee relations issues, including workplace disputes, performance concerns, and compliance matters.
- Conduct legal research on employment and labor law issues, preparing reports and recommendations for management.
- Support HR and legal teams in managing employee grievances, terminations, and other employment-related matters.
- Assist in audits and compliance reviews related to immigration and employment processes.
- Build and maintain strong relationships with employees, clients, and external legal counsel to foster trust and collaboration.
Qualifications:- Minimum of 7 years of experience as a paralegal with a strong focus on IT employment and labor laws, U.S. visa processes, and employee management.
- Bachelor’s degree in Paralegal Studies, Legal Studies, or a related field. Paralegal certification preferred.
- In-depth knowledge of U.S. immigration laws and processes, including H-1B, OPT, CPT, Green Card, and EAD.
- Proven experience working with IT staffing companies or handling legal matters related to IT employment is highly desirable.
- Familiarity with employment eligibility verification (I-9) and E-Verify processes.
- Strong organizational skills with the ability to manage multiple tasks and meet deadlines.
- Excellent communication and interpersonal skills, with the ability to effectively interact with employees, clients, and legal counsel.
- Expertise in drafting and reviewing legal documents, including employment contracts, visa petitions, and other legal documentation.
- In-depth knowledge of federal and state labor laws, including wage and hour laws, anti-discrimination laws, and workplace compliance requirements.
- Ability to handle sensitive and confidential information with discretion and professionalism.
- Proficiency in using legal research tools and software.
Good to Have:- Master’s degree in Legal Studies or a related field.
- Paralegal certification from an accredited institution.
- Experience in working with IT staffing firms or consulting companies.
- Familiarity with tax terms such as W2, C2C, and 1099, and their implications for employment contracts.
